By using the Services, you represent and warrant that you:
- Are at least 18 years old or otherwise have legal capacity to form a binding agreement in your jurisdiction;
- Have full authority to accept these Terms on your own behalf or on behalf of an organisation you represent;
- Will comply with all applicable laws in connection with your use of the Services.
2. Services and Permitted Use
ResumePilot provides tools for resume drafting, cover letter generation, role matching, and related workflow support.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal or internal business purposes.
We may modify, enhance, suspend, or discontinue any aspect of the Services from time to time, including features, integrations, and functionality.
3. Accounts and Security
You are responsible for maintaining the confidentiality of account credentials and for all activity occurring under your account.
You must promptly notify us of any unauthorised access or use.
We may require identity or account verification, and may suspend access where we reasonably suspect unauthorised activity or security risk.
4. Acceptable Use Restrictions
You must not:
- Use the Services in breach of any applicable law, regulation, or third-party rights;
- Upload malicious code, attempt unauthorised access, or interfere with platform integrity, security, or availability;
- Reverse engineer, scrape at scale, reproduce, or exploit the Services except as expressly permitted by law;
- Use the Services to generate unlawful, defamatory, fraudulent, discriminatory, or harmful content;
- Misrepresent generated content as legal, regulatory, or professional advice where it is not.
5. User Content and Responsibility
You retain ownership of content you submit to the Services, including resumes, profile data, and documents ("User Content").
You grant us a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, adapt, and transmit User Content solely as reasonably necessary to provide, secure, and improve the Services.
You represent and warrant that you have all rights and permissions necessary for User Content, and that User Content does not infringe third-party rights.
6. AI-Assisted Outputs
The Services may produce AI-assisted content, recommendations, and draft materials ("Outputs"). Outputs are probabilistic and may contain inaccuracies, omissions, or unsuitable language.
You are solely responsible for reviewing and validating Outputs before relying on or using them for employment, legal, immigration, or other high-impact decisions.
ResumePilot does not guarantee interview outcomes, hiring results, suitability assessments, or job placement outcomes.
7. Third-Party Services and Integrations
The Services may interact with third-party platforms, APIs, and services. We do not control third-party services and are not responsible for their content, availability, terms, or privacy practices.
Your use of third-party services is governed by those third-party terms and policies.
8. Fees, Billing, and Plan Changes
Some features may be offered on a paid basis. Where fees apply, pricing, billing cadence, and payment terms will be disclosed at purchase or in-plan documentation.
Unless otherwise required by law, fees are non-refundable once a billing period commences. We may revise pricing or plan structures by giving reasonable prior notice.
9. Intellectual Property
ResumePilot and its licensors own all rights, title, and interest in and to the Services, including software, code, interfaces, branding, templates, and documentation, excluding User Content.
No rights are granted except as expressly set out in these Terms.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
11. Suspension and Termination
We may suspend or terminate access immediately where we reasonably consider that you have breached these Terms, posed a security risk, or used the Services unlawfully.
You may stop using the Services at any time and may request account closure subject to legal and operational retention requirements.
Clauses intended by nature to survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) survive termination.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not warrant uninterrupted access, defect-free operation, complete accuracy, or fitness for a particular purpose.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other non-excludable law.
13. Limitation of Liability
To the maximum extent permitted by law, ResumePilot and its officers, employees, contractors, and licensors are not liable for indirect, incidental, consequential, special, punitive, or exemplary loss, including loss of profits, revenue, goodwill, opportunity, or data, arising out of or in connection with the Services.
To the extent permitted by law, our aggregate liability for all claims arising under or in connection with these Terms is limited to the greater of:
- The total fees paid by you to ResumePilot in the 12 months immediately preceding the claim; and
- 100 Australian dollars (AUD $100).
Where liability cannot be excluded under the ACL, our liability is limited to the remedies permitted under section 64A of the ACL.
14. Indemnity
You indemnify and hold harmless ResumePilot and its related entities, officers, and personnel from and against claims, liabilities, losses, damages, costs, and expenses (including legal costs on a full indemnity basis) arising from:
- Your breach of these Terms;
- Your misuse of the Services;
- Your User Content or violation of third-party rights or law.
This indemnity is reduced to the extent a claim is caused by our own unlawful conduct or negligence.
15. Governing Law and Jurisdiction
These Terms are governed by the laws in force in New South Wales, Australia, unless mandatory law in your jurisdiction requires otherwise.
Subject to mandatory consumer protections, you and ResumePilot submit to the exclusive jurisdiction of the courts of New South Wales and courts of appeal from them.
16. Changes to these Terms
We may amend these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date.
